Debt Collection Violations
RFDCPA Notice Violation
Along the left margin, we have attached notes that explain some common misunderstandings. These are not complete. The FDCPA and the RFDCPA are very technical in nature and violations may occur of which laymen are unaware.
If you have questions about the FDCPA or any statute, you should contact a lawyer.
California's Rosenthal Fair Debt Collection Practices Act, California Civil Code ยงยง 1788 et seq, requires that in the first written notice initially addressed to a California address of a debtor in connection with collecting the debt by the third party debt collector a certain notice be included in that letter.
In the letter on the right, the debt collector has failed to include that notice, which is a violation of the law.
Hyde & Swigart brought a lawsuit in this matter for the consumer.
